[email  protected] edu BUS 685 Global Business Management Case 1 – The Bribery Scandal at Siemens AG Overview The report will analyze the case study and discuss the bribery scandal at Siemens AG. The author of the case study paints a picture of a successful and arguably dominant multi-national firm, with a reputation for a war chest of competencies and innovative products. The obvious question, then, is why would a firm with this resume and list of global achievements become involved with corruption and criminal behavior?Therefore, the case study raised questions such as the accountability of senior managers to the rampant corruption occurring in global divisions. Summary On November 15, 2006, 30 offices and private homes were raided by 200 police officers, tax inspectors, and prosecutors in Munch and other cities in Germany to investigate suspected bribery, embezzlement of company funds, and tax evasion. Five Siemens employees were taken into custody in connection with the case. Swiss prosecutors were also involved in the raids because they had an independent investigation on three people connected to Siemens, which launched in 2005.As a result, there was â‚ ¬420M of questionable payments made over a sevenyear period from 1999 to 2006. Official Siemens records showed the payments as having gone to external consultants. It was determined, however, that the funds were actually paid to foreign purchasing officials and that the expenditures coincided with the procurement of â€Å"fixed-line line telecommunications business in various international markets,† including Italy, Puerto Rico, Greece, and the United States. Siemens acknowledged that certain company employees were engaged in fraud, and the damage to the company could be around â‚ ¬10-30M.Because of the fraud Siemen’s was burdened with an additional â‚ ¬168M in income tax charges since 1999. Their net profit was restated from â‚ ¬3. 106 B to â‚ ¬3. 033B. By the spring of 2007, two former Siemens managers were convicted of embezzlement of company funds (â‚ ¬6M) for the purpose of bribing foreign officials to win a natural-gas turbine contract. The employees argued that their actions did not violate any laws, resulted in no personal gain, and were taken solely for the purpose of improving Siemens’ positioning.They argued that they worked only to secure a lucrative deal in which the payments were required by Enel management as part of the standard bid process. In fact, Siemens AG argued that the court order requiring forfeiture of earnings from the contract, prior to 2002 when the German government instituted a law prohibiting bribes to private officials abroad, specifically, had no basis in law. Analysis It took approximately 200 government officials, made up of police officers, tax inspectors, and prosecutors to indite five Siemens employees.The result was that the company was fined â‚ ¬30M, which wa s approximately 7% of the total â‚ ¬420M in bribes Siemens paid out. Combined, Siemens lost a total of â‚ ¬450M in 2006. Therefore, the company had to restate their net profits for 2006 from â‚ ¬3. 106B to â‚ ¬3. 033B. The adjustment was a mere 1. 4% of their total net profits in 2006. Two Siemens employees gave out bribes worth â‚ ¬6M in order to win contracts. The punishment for these briberies was a fine of â‚ ¬44M; however, the contract awarded to Siemens was worth â‚ ¬450M.Therefore, the company’s gain was a profit of â‚ ¬406M. The penalties Siemens paid were roughly 10% of the overall profit made from the contract. So was it worth it for Siemens to engage in criminal behavior? The punishment they received of paying fines varying up to 10 percent were only a drop in the bucket compared to the profits they gained. So from the viewpoint of a Siemens employee who is willing to break the law in order to gain large profits, it was definitely worth it.A s a matter of fact, if a company anticipates the percentage of penalties that will be applied for breaking the law, they could actually build that figure into their contract award fee and then move on with the business as usual. Furthermore, in addition to the financial repercussions Siemens experienced, the case study also mentioned damages to their reputation. In the end, however, Siemens’ growing profits did not reveal any decreases due to a damaged reputation. By 2011, Siemens ended up making more money than they had in the last five years, since 2007. From 1999 to 2006, their combined net income was â‚ ¬26. 3B (over seven years), and from 2011 to 2007, their combined net income was â‚ ¬31. 95B (over five years). Discussion Questions 1. Is unethical behavior the cost of doing business? What exactly is the role of Senior Managers? 2. Was Siemens penalized enough? Should fines be used as a deterrent to bribery? Are these the effects of the absence of adequate laws or weak enforcement practices? 3. Relativism vs. Normativism (Co-Determination Law). Relativism is the idea that ethics and morals are based on the context of a situation; the people involved, and their beliefs.Normativism is the idea of universal law based on what is good for everyone alike. So in this situation, would it be more appropriate to view Siemens’ actions in the context that they were simply trying to make profits? Conversely, would it be more appropriate to view the situation as what might be good for one company is not good for others, creating an unfair playing field? Would you apply relativism or Normativism to this case study when examining the Co-Determination Law? 4. Can you discuss in your own words, what is the difference between lobbying and bribery?Recommendations 1. Executive Ethics Program – Mandate that anyone equal to or above a director level to undergo a specialized business ethics and regulations program for executives. We should hold the gov ernment responsible to provide this training. The program would be taught by people who enforce the law, such as litigation lawyers and prosecutors. Training the people in the company at the level where the bribes derive from is much more appropriate than mandating a company-wide training where only lower level employees will end up receiving this training. 2.Levy Stricter Fines – Any company caught giving bribes for any reason will not be allowed to keep the profits they made as a result from the contracts won. The fines the company will owe to the government will be the equivalent to the gains received or the potential value of the contract being awarded. If the company is found guilty, they must walk away from the contract, allowing other companies that did not break the law to rebid on the contract. 3. Two Years of Probation – companies that break the law will not be allowed to bid on any contracts in the industry in which the contract existed, i. . a contract with an Energy Company would prevent further bids on any contracts in the energy industry for two years. Lessons Learned 1. 2. 3. 4. A strong ethical culture is critical for effective corporate governance. Merely publicizing the need for integrity won’t bring it about. Senior executives need to know what is going on throughout the organization. Strong internal control is more important in a widely dispersed and decentralized company. 5. Beowulf Paper

This old Chinese Proverb has stood the test of time and is true today as it was in the 1 100's. Like the rest of us, Beowulf endured a Journey. Although filled with much more peril and hardships than the average adult, Beowulf ultimately reached his destination. This begs the question, which is more important†¦ the Journey, or the destination? Having a healthy focus on both the Journey and the destination allows one to reach the desired goal ith the same enthusiasm as you started.Lines 690-693 illustrates how Beowulf focused on the Journey of acquiring riches and essentially wasted his life when he, while grasping for his last breath, told Wiglaf â€Å"l sold my life for this treasure, and I sold it well. Take what I leave, Wiglaf, lead my people, help them; my time is gone† (47). During his heroic life, Beowulf was, by todays standards, ‘The Man. ‘ Every individual with a fear looked up to this great leader, as he traveled from kingdom to kingdom destroying e vil. As inspiring as this as, he lacked the one key factor to being truly successful-a goal.Having a goal, or destination, is as important as the Journey itself. Giving yourself closure to the whole purpose of your actions will leave you with a feeling of success and a reason for your hard work. Beowulf lacked this, and led a life of blind deeds. Although helpful to his followers, he died a truly unhappy man, as inferred from the previous quote. Beowulf needed to have a set goal; a life he envisioned living after he was done kicking butt. This gives purpose and a drive behind everything he did. Instead, he lived an awe- inspiring Journey, but never set a destination to make him truly happy.There is a plus side to his mistake, though. We can take what has been learned the hard way by our friend Beowulf and apply this to our own lives. Nothing can beat the feeling of success. It doesn't matter if the scale dropped a couple numbers, or that pesky center dot is finally demolished in the shooting range. The feeling of accomplishing the set goals cannot be overlooked. Now, that may seem easy, but the amount of effort and practice required to reach that success is as mportant as the feeling itself.This is the Journey versus destination taken out of context. In order for the scale to drop (the destination), one must put in lasting effort to get where they want to go (the Journey). More than often, one loses focus on either one of these aspects. This is the cause of failed goals. The importance of balancing focus is difficult, but required for true success. Beowulf stresses the importance of both in lines 365-368: â€Å"He leaped into the lake, would not wait for anyone's answer; the heaving water covered him over.For hours he sank through the waves; At last he saw the mud of the bottom† (38). Now, say Beowulf Jumped into the lake, and halfway through he became so focused on swimming at his best he gets to the destination, and forgets why he is there. Hrothgar a nd the Danes would not be pleased! Alternatively, what if he focused too much on destroying Grendel and his mother that he swims in the wrong direction? Again, it would not end well for the poor Danes. The importance of one's healthy focus is not to be taken lightly. urney, there are many dangers that wait; lurking, ready to destroy all hopes of success. If one was to focus completely on the Journey, they start to lose a sense of who they are. Losing sight of the goal and the purpose behind the goal becomes all too evident. Friends may be lost, because all attention is on the here and now. Likewise, focusing on the destination is Just as dangerous. One loses sight of what is necessary to accomplish the goal; too caught up in what awaits them in the future.Many fall unsuspected to these traps, and are forced to restart and replan. This is most clearly seen in lines 12-18 when Hrothgar thinks he has reached his destination. Then Hrothgar, taking the throne, led the Danes to such glory that comrades and kinsmen swore by his word, and young men swelled his armies, and he thought of greatness and resolved to build a hall that would hold his mighty band and reach higher toward heaven than anything that had ever been known to the sons of man. † (27) Hrothgar thinks he has finished his Journey and reached his destination.Little does he know, Grendel is about to demolish everything he has worked for and ause him to replan everything; including his destination. Finding a healthy balance between the destination and the Journey is crucial to being truly successful in any area of life. It takes great experience to find this, and many have failed. Once this balance is acquired, though, it is more rewarding than anything else, because unity and closure is provided to years of hard work and dedication. The next time New Year's comes around, think of what is needed to finally win against the seemingly unbeatable resolution. Beowulf Paper In the poem Beowulf, translated by Seamus Heaney, Beowulf is the ultimate hero who places himself at great risks to perform multiple acts of courage. Beowulf is the typical heroic story of good verse evil. He has great amounts of physical strength in which he uses to put his life on the line for the entire kingdom. Beowulf’s pursuit moves him from Geatland to Denmark on a quest to help Hrothgar’s kingdom that had been plagued of attacks by an evil monster named Grendel. He also goes on to defeat Grendel’s mother and battles a fire-breathing dragon. Eradicating Grendel and Grendel’s mother bring Justice and peace to the Scandinavian society, while Beowulf receives much fame. The story goes on to define his pursuit of fame through his three main battles, moving from a warrior perspective, to one of a king. Beowulf’s quest brings him to change his responsibilities. The ideals of a once young warrior develop into a more experienced man that comes to rule the community of Geatland. A warrior trying to establish himself in the world ultimately has a goal striving for fame. One seeks fame through bravery in the face of danger, having much strength, despising death, and boasting about their accomplishments (SparkNotes Editors). Beowulf searched for individual fame and glory for his entire life. His pursuit to become a hero was strong enough to take on the evils of the world. He was able to achieve individual fame upon hearing of Hrothgar’s troubles with Grendel. He set sail to gain personal fame and to help the community of Heorot. The people of Hrothgar’s land found Beowulf to be a hero for he was about to rid them of their enemy. But Unferth thinks differently and challenges Beowulf’s stating â€Å"no matter therefore, how you may have fared in every bout and battle until now, this time you’ll be worsted; no one has ever outlasted an entire night against Grendel† (37). Unferth challenges Beowulf’s heroic character. Unferth bitterly attacks Beowulf, which clearly reveals Unferth’s jealously towards him. Unferth feels below Beowulf. He cannot protect his own land because he is afraid of Grendel. Unferth will not be a warrior who obtains fame nor will he be a heroic warrior. No one will remember Unferth as a great legend; rather he falls into a category of one who is bitter (SparkNotes Editors). This goes to show that the quest for fame can lead to harm. In Unferth’s case, the quest for fame led to pride, which involved a desire to be great no matter what. Beowulf desired to be great but his desire for fame was associated with the desire to bring strength and power to one’s people. Beowulf connected fame with generosity and community while Unferth mixed pride up with greed and selfishness, for he wanted to succeed. Beowulf ultimately succeeds in killing Grendel and Grendel’s mother in two heroic battles in which he used his bare hand strength to defeat the two monsters. Beowulf is ultimately a great example of what a hero is. A hero will always fight to win a battle, but does so in a fair manner. Beowulf, for example does not use a sword in the midst of the battle between Grendel and he. â€Å"He began to remove his iron breast-mail, took off the helmet and handed his attendant the patterned sword, a smith’s masterpiece, ordering him to keep the equipment guarded. And before he bedded down, Beowulf, the prince of goodness, proudly asserted: ‘when it comes to fighting, I count myself as dangerous any day as Grendel. So it won’t be a cutting edge I’ll wield. He has no idea of the arts of war, of shield or sword-play, although he does possess a wild strength. No weapons, therefore for either night; unarmed he shall face me if face me he dares’† (47). Instead he uses his very own strength, courage, and ability to kill the enemy. Beowulf is so strong, courageous, faithful and loyal that it can be questioned whether he is truly man or myth. He posse’s hero like strength that is superior to the normal human man. He truly did do whatever he needed to save and protect the people (Beowulf Papers). Death was not a fear that crossed his mind for he was not afraid of it! A hero is one who is not seen very often and there are only a few great heroes that come about in time (Beowulf Papers). They are a step above the average. A hero brought peace to situations that were before seen as impossible and bring joy to many people. A task such as defeating Grendel’s mom’s grip in battle, is one that only a hero could perform for it was impossible for others (SparkNotes Editors). What others deem impossible, a hero makes possible (Beowulf Papers)! Beowulf can ultimately be defined as a hero. Can the reward of fame for being a brave warrior only be achieved through worldly success? It seems that this is true but Hrothgar tries to advice Beowulf of eternal rewards. â€Å"O flower of warriors, beware of the trap. Choose, dear Beowulf, the better part, eternal rewards. Do not give way to pride. For a brief while your strength is in bloom but I fades quickly; and soon there will follow illness or the sword to lay you low, or a sudden fire or surge of water or jabbing blade or javelin from the air or repellent age. Your piercing eye will dim and darken; and death will arrive, dear warrior, to sweep you away†(121). Hrothgar become a father figure to the young Beowulf. He does not want to see Beowulf give way to pride. This piece of advice is jarring with the culture of boasts and reputation that other parts of the poem emphasize (SparkNotes Editors). Life is also brief and he should look towards those rewards that may be eternal rather than the reward of fame. This passage portrays a fragile outlook on Beowulf’s delicate life that can be taken away at any time and the fact that his youth will indeed fade quickly (SparkNotes Editors). He may not only be stabbed which will wound, but he will also lose his youth as time goes on. Beowulf needs to focus on honor, nobility, and leadership, not just on his physical skill and strength (SparkNotes Editors). Beowulf had no fear, and desired personal praise, while Hrothgar had much to lose and valued protecting his people. Each of these two roles filled two different sets of shoes, and each character acted as society expected. With that said, over the course of the poem Beowulf does grow from a courageous warrior to a wise leader. Hrothgar’s speeches emphasized stability and security for his people and this was shown through him building the mead hall for the people to gather. He also demonstrates loyal service to his warriors by giving them lavish gifts and much praise. Beowulf transitions from a young warrior into the King of the Geats and he does exemplify much of the characteristics and values of Hrothgar. At the end of the story though, after fifty years of serving his people, Beowulf encounters a battle with a dragon and this battle conflicts with his warrior and king duties for he was a king and the state needed him. Beowulf, old and tired, defeats the dragon that was frightening all the people, but he does lose his life, leaving the Geats open for attack. Was this the wrong act? It is hard to decipher between the two roles for they were conflicting and the tension between the two was inevitable. Even near death, Beowulf did wish for a lighthouse that be built so people could find there way back from sea showing his never ending concern for the Geats. Beowulf was not afraid of death and before any battle he made a wish that his assets be given to the people. In life or death, Beowulf will be glorified. Epic battles, terrifying monsters, extraordinary strength, and great leadership; these characteristics and encounters are what make up the epic hero that is Beowulf (Definition Of Hero On The Web). The heroism exemplified by Beowulf is defined by many different qualities. A hero is again defined by his willing to put himself at great risk for the greater good. The monsters that invaded the Heorot land were all outsiders that existed beyond the boundaries of human realms. Beowulf was forced to kill the two beasts in order to restore order because Grendel and his mother had infringed upon human society. Fame was a theme touched based on throughout the poem. Fame was part of Beowulf’s quest, but Hrothgar left an impression on Beowulf’s values. He reminded him that his fame and strength are not always going to be available to him. His life is fragile and he could not only be killed, but his youth clock is ticking. Beowulf is painted as a perfect hero in the form of the protagonist in the poem. The poem consists of three central conflicts, which include Grendel’s rage of Heorot Hal, Grendel’s mother becoming vengeful because of her sons death, and the dragon’s rage over Geatland. The difference between a good warrior and a good king was also a theme in which was observed through the poem. What others deem impossible, Beowulf made possible! References Heaney, Seamus. A comparison of the company’s tr eatment of the DB032 drive belt and the EG151 exhaust gasket reveals that it has gotten its priorities completely wrong. The more in-demand product (EG151 exhaust gasket) has been given a small lot size and is undersupplied, while the less in-demand product (DB032 drive belt) has been given a large lot size and is overstocked to the extent that almost 3 weeks’ supply is on hand. In order to solve this problem, it is necessary to develop a better and more efficient inventory system. I propose the following: For the EG151 Exhaust Gasket At least 150 units should be ordered every week so as to cushion the company from stockout and an inability to meet demand. In addition to this, the product should be given a larger lot size that can allow its inventory to be sufficiently built and maintained. The company should also improve the efficiency of its supply chain system so that backordering is reduced, losses are avoided, and market share is maintained or even gained. For the DB032 Drive Belt The lot size allocated to a product that sells an average of just 50 units each week is too much and not realistic. Allocating a lot size of 1,000 units to this product is almost criminal considering the EG151 exhaust gasket undersells and yet is given a lot size of just 150 units. Secondly, the company orders too many units of the DB032 drive belt, to the extent that surplus units are left in stock while demand remains low. Last poem Essay Dogen was greatly surprised by the fact that making a strong accent on the study of koan Chinese masters did not teach their disciples Buddhist sutras, which made the core study in Buddhist monasteries in Japan (Tanahashi, 5). Dogen’s discontent with the style of teaching became even a reason of his refusal to take Dharma transmission from one of the masters. In 1225 Dogen decided to leave Rinzai school of Chan Buddhism and started his journey in order to visit Ru-jing, whose style of Zen teaching differed from ones which disenchanted Dogen. Ru-jing was the thirteenth patriarch of Soto lineage of Zen Buddhism. During that time he lived at Tiantong Mountain in Nongbo. Soto school, presented by Ru-jing made an accent on sitting meditation, or zazen. In general it used much softer methods than Rinzai School did. Studying Zen with Ru-jing Dogen has finally reached enlightenment of mind and body. The legends state that he finally reached liberation after hearing the Master’s words: â€Å"Cast of body and mind† (Tanahashi). These words became especially meaningful for Dogen and he later used them in many his writings. As he states in one of his works: †To study the Way is to study the self. To study the self is to forget the self. To forget the self is to be enlightened by all things of the universe. To be enlightened by all things of the universe is to cast off the body and mind of the self as well as those of others. Even the traces of enlightenment are wiped out, and life with traceless enlightenment goes on forever and ever† (Kim, 195). In 1227 Dogen received Dharma transmission from Ru-jing and finally admitted that he has reached the answer for the question of all his life. Dogen was greatly influenced by his teacher Ru-jing. All Dogen’s religious philosophy is marked by two major tendencies. The first peculiarity of all Dogen’s teaching is his attachment to Buddhism tradition and second one is a strong accent on individual search. These tendencies can be traced not only in Dogens’s books but also in his lifestyle. Dogen did not reject traditional Buddhism. He only wanted people to give critical evaluation of its doctrines and principles. Dogen criticized competition among different schools of Zen because they were tiring Buddhism to pieces. He proclaimed identity of faith and believed it could have been found in Soto Zen. He did not even want to apply the name Zen for his sect and did his best to follow his teacher’s lifestyle living without attachment to anything. In 1228, after reaching enlightenment, Dogen returned to Japan. He came back to ti Kennin-ji, a monastery where he spent several years learning from Eisai and his successors. After coming back he wrote a detailed description of sitting mediation called Zazen. The manual was called Fukan Zazengi, which can be translated as â€Å"Universally Recommended Instruction for Zazen. † His teaching appealed to many people and he gathered a lot of adherents around himself. After some time he had to leave Kennin-ji because of tension, which arouse inside the Tendai community. This tensions with caused by the desire of Buddhist leaders to suppress new forms of Buddhism, including Zen. Dogen left Kinnin-ji temple in 1230 and moved to empty temple situated to the south from Kyoto in the place called Uji (Tanahashi , 40). Dogen founded small temple in this place and soon this temple grew into Kosho-Hirniji Temple. The tension between Dogen and Tangai community did not stop, though. That is one of the reasons Dogen gladly accepted Hatano Yoshishige’s proposition to relocate to Echizen province, located far from Kyoto. After relocation Dogen’s disciples built a new center for Zen practice and called it Daibutsuji Temple. Dogen later renamed this center to Eihei-ji. This temple remains one of the most popular Zen temples in modern Japan. Dogen spent all his further life living and teaching in this temple. Shogun regent Hojo Tokiyori invited Dogen to come and teach him Zen in 1247. Dogen accepted this invitation and made a long journey to Kamakura in order to meet Shogun and retuned to Eihei-ji the next year. In 1252 Dogen became seriously ill and after realizing that he was not going to recover he gave his robes to his favorite disciple Koun Ejo. This way Koun Ejo became Abbot of Eihei-ji. After appointing Koun Ejo an abbot Dogen left for Kyoto looking for remedies from his illness. The remedy was not found and Dogen died in 1953. Soon before death he wrote his last poem.

Quality Management in the Public Administration through CAF ESF 4.159 – Developing Quality Management in the Public Administration through CAF (SLIDE 3) The Commissions main Thematic Objectives are set out in Article 9 of the Common Strategic Framework. Each common strategic framework contributes to the Union strategy for smart, sustainable and inclusive growth. Such objectives may be translated into specific priorities to each common strategic framework fund. The European Commission believes that the respective member states should continuously improve the environment for their businesses, citizens and stakeholders by means of the modernization of public administration. The chosen project falls within the 11th Thematic Objective that seeks the enhancing of institutional capacity and efficient public administration through stronger institutional capacity and more efficient public administration supported the European Social Fund (ESF). (SLIDE 4) In total the amount of ESF funds allocated to this project amount to a total of three hundred and thirteen thousand, three hundred and seventy euros. The central objective is that of strengthening efficiency and effectiveness of the public administration through lifelong learning and innovative activities. These are the main funding information including the total amount of allocated funds and the areas of intervention. (SLIDE 5) Through such investment economic improvement is one of the main drivers. This will be achieved from better business environment and other societal and economic impacts of the subject stakeholders. The EU Commission will specifically assess: The needs of stakeholders in order to improve the delivery through quality management systems, and; That there is also a set of actions, referring to the establishment and use of already set quality management systems in a sustainable way. (SLIDE 6) Before the implementation of this project, the situation within the Maltese Public Administration was characterised by limited use of quality management systems. Nevertheless, elements such as the CAF, customer care and redress, online portals, service charters, directives and guidelines, eGovernment, one stop shop, Local Councils (as an alternative delivery channel), partnerships with NGOs and capacity building only existed to a limited extent. This project seeks to develop the skills and competences of public officers in the application of the CAF and central competencies within the Management Efficiency Unit (MEU). This would be achieved through training and networking of CAF users and experts. This also leads to commitment that improves the public service delivery through burden reduction of regulation and administrative procedures, quality assurance and control. Service delivery would increasingly become professional, fair, transparent and outcome-oriented. Service users would also be able to choose from channels of delivery which should be as close as possible to them. For such achievements the MEU would become a centre of excellence as regards the CAF. It would be able to strengthen the public sector in CAF implementation and the management of certification in order to ensure long term-sustainability. To obtain such objectives, adoption of better practices, maximizing of partnership synergies, leverage technology and the pursuing of corporate social responsibility are essential tools. (SLIDE 7) The CAF model is mainly based on 3 pillars that are; Structure, Process, Outcome. Structure (or Leadership) holds that; CAF is based on 2 key elements that are: Enablers and Results and that; Each enabler and result is further broken down into key sub-criteria Process holds that; CAF is rooted on a team’s view of the position of an organisation at a particular point in time and that; CAF nurtures a continuous improvement mindset within an organisation Outcome holds that; Benefits for the organization’s stakeholders, image and reputation (SLIDE 8) Assessment of the achievement of desired achieved goals is done through the PDCA cycle. Basically this cycle observes the; Initiation of the project such as the: Planning and organization of the process and Communication within the organisation Carrying out of self-assessment such as the: Setting up of the self assessment team Training and data gathering and Self assessment Planning and execution of improvements includes: Prioritization and planning Communication of the improvement plan ad Periodic review of the project (SLIDE 9 and 10) Scoring of sub-criteria is based on the PDCA cycle which typically takes between 6 to 10 weeks depending on the complexity and scale of the issue at stake. The 6 main criteria for fulfillment under conditionality 11 will achieve results into 3 main areas, which are of a Societal, Citizen and Workforce nature. All achievements lead to further economic efficiency within the subject organisation. Societal, Citizen/Consumer, and People/Workforce benefits will be achieved: Societal improvements include: Improvement in quality of life Adaptation to trends Proactive holistic approach Stakeholder engagement Transparency Citizen improvements include: Faster delivery Improved service level Cost-efficient operations Image and reputation Workforce improvements include: Motivated workforce Role clarity and involvement Improved commitment to mission Better resource utilisation Reduced skill gaps (SLIDE 11) 4 key strategic objectives form the core of this project: CAF as Quality Management System (QMS): that Promotes and implements the CAF as the Maltese Public Administration’s first choice of quality management system It is anticipated that strategic initiative to attain this strategic objective include but are not necessarily limited to: further roll out of CAF within Government; providing implementation support, enablement and capacity to Department and Government Entities implementing CAF; once a critical mass of Departments and Government Entities have adopted CAF, a quality award is introduced to recognize achievement; sharpening the focus on results and outcome orientation; and introducing CAF in education and justice sectors. Partnerships: that Strengthen partnership development and management between the Maltese Public Administration and its stakeholders It is anticipated that strategic initiatives to attain this strategic objective include but are not necessarily limited to: providing guidance and building capacity in partnership development and management; developing further strategic partnerships in various sectors; extending consultation to service design; sustaining and improving on corporate social responsibility; strengthening a proactive information policy; and developing a corporate identity kit for the Public Administration. There are all areas where citizens, service users, and stakeholders can act together in co-design, co-decision making, co-production and co-evaluation. Services/Processes: Improves the way services and associated business processes operate and innovate within the Public administration It is anticipated that strategic initiative to attain this strategic objective include but are not necessarily limited to: improving and innovating services and channels in use within the Public Administration; developing capacity to implement business management; further supporting business processes with ICT; better records management; maximizing citizen/customer suggestion and complaints system; and introducing systematic citizen/customer satisfaction measurement. People: Develops the capabilities of the Public Administration workforce in customer service, partnership development and quality management systems It is anticipated that strategic initiative to attain this strategic objective include but are not necessarily limited to: sharpening the focus on performance management to ensure accessibility, transparency, quality of service delivery, involvement; training and development of Public employees in the required toolkit; and introducing climate and culture perception surveys with staff. (SLIDE 12) Current state-of-play: The adoption of a quality management framework would build on these efforts and works towards a more consistent approach to continuous improvement. CAF is a core tool to achieve sustainable excellence in all performance aspects. Actions are based on the premise that excellent results with respect to performance, customers, people and society are achieved through leadership driving policy and strategy, that is delivered through people partnerships, resources, processes and change management. Unlike various other quality management models CAF is specifically targeted for public administration and is capable of capturing unique features of government organisations, holds a high degree of flexibility and may be used n a wide variety of circumstances. For this reason, CAF plays an enormous role in Malta’s National Reform Programme under the Europe 2020 strategy. By the adoption and promotion of CAF, the MEU would be increasing its level of self-assessment. MEU also aims to become the Maltese centre of expertise through the strengthening of its in-house capacity. (SLIDE 13) Three types of training that have been delivered by the European Institute of Public Administration in Mata include: A Specialised Training Programme in CAF delivered by CAF experts to 14 members (out of a total of around 20) of MEU staff; A CAF Model Training Programme delivered by CAF experts to 6 groups of public officials; and Training on the Procedure on External Feedback and the CAF Label Training Programme delivered to members of MEU staff and public officials in the public sector. 154 civil servants were trained in the TQM approach for the public sector to obtain knowledge on relevant concepts of quality development from a holistic perspective†¦ the content of quality instrument that have been used successfully over the past decade in many public sector organisations in many countries and the adequate processes of implementation. Additionally, a group of experts was also trained in the Procedure of External Feedback, assuring qualitative progress in future organisational development. A CAF website has also been created. 3 CAF user organisations in Malta and Gozo have also been registered. Each after successfully completing a cycle of CAF assessment and implementation. (These are the Gozo Public Library, the Food Safety Unit and the Gozo Sports complex.) These users were also made subject to the process of concluding their second self-assessment, which would lead them to achieve the CAF Label certification. It should also be noted that the CAF Label Certification is valid for 2 years and thus each government entity would have to be assessed and certified every two years. Other 5 public organisations including Appogg and Sedqa have engaged in CAF towards excellence with the assistance of the MEU. (SLIDE 14) SERVIZZ.GOV portal is an online portal whereby citizens can complain with Local Councils and entities. There are pre-set timeframes for closure of the complaint, typically 10 or 20 days depending on the subject case. A significant percentage of complains are anonymous and some 95% of cases originate from Local Councils. MEU developed an in-house data warehouse to analyse trends and responsiveness. Overall, Local Council and entity responsiveness are analysed. MEU also monitors customer complaints performance regularly and validates closure on a sample basis. CUSTOMER CARE and REDRESS. All line ministries have customer care officers within their organisational structures. There are also administrative customer care officers within designated Directories within Ministries which route complaint resolution and monitor complaint closure. The major regulatory authorities, Departments and Government entities have various forms of customer care offices in operation. Training to Customer Care officers has been provided by the MEU and the CDRT/OPM. Redress mechanisms available include the office of the Ombudsman, Tribunals and the Law Courts. QUALTY SERVICE CHARTERS. Charters spell out the rights of citizens as customers of a Public Service and specify the quality of service that can be expected. A department holding a charter will commit itself to stated performance targets; typically on waiting times, quality of product, courtesy and information provided. Charters also explain how to lodge complaints. In the light of government commitments, it is the opinion of the MEU that it is worth revising the Quality Service Charter initiative to reflect the changing times and resources of the Public Administration. However, such initiative should be as simple as possible, by monitored and audited regularly by third parties, independent of the servicing Department such as the IAID (i.e. for auditing purposes). ONE STOP SHOPS. Business First one-stop-shops run by Malta Enterprise since the beginning of 2012 with only 5% of total number of applications not being delivered within the prescribed deadline. The Malta Financial Services Authority can register a limited liability company within 48 hours provided the correct documentation is submitted. Local Councils are seen as the key means to move Public Services closer to citizens and service users. They already offer a range of community services. However, more work needs to be done to bring the most-frequently-used Public Services within the locality. (SLIDE 15) Through all these actions this project will lead to significant economic results.
